Terms and Conditions – Forever Festival
Article 1. Definitions

“Event”: Any activity designated by the Organizer, including festivals, music events, and catering/hospitality in the broadest sense, in collaboration with the producing/performing party.

“The Organizer”: The legal entity responsible for the production, organization, ticket sales, and execution of the Event. The Brand Owner (Stichting Festival Xperience) only grants a license for the use of the brand name and is explicitly not the Organizer of the Event.

“Visitor”: The (legal) person(s) who has validly purchased or obtained an admission ticket for an Event organized by the Organizer, and any person wishing to access an Event with a valid admission ticket.

“Ticket” or “Tickets”: A (digital) document or (bar)code provided by or on behalf of the Organizer, which allows the Visitor to gain access to the specifically designated Event.

“Tokens”: Coins issued by the Organizer, which Visitors can purchase for an amount determined by the Organizer, and which can be used as a means of payment at locations designated by the Organizer during the Event.

“Grounds”: All buildings, (covered or uncovered) spaces, and fields that form part of the area where the Event takes place, including access routes and parking lots.

“Accommodation”: A specific part of the Grounds designated by the Organizer for the Visitor to stay during the Event, which may or may not be provided with specific facilities (e.g., festitent, kartent, festipi, flexotel, and “friends-spot”). Facilities are also included under Accommodation.
Article 2. Applicability
2.A. These terms and conditions apply to every part of the agreement and offer relating to services or products of any nature to be provided by the Organizer, unless expressly agreed otherwise in writing. 2.B. These terms and conditions can be consulted and saved via the Event website and are available for inspection at the Event entrance. House rules may apply to an Event. House rules can be consulted via the website of the relevant Event and the Organizer and are available for inspection at the Event entrance. The Visitor hereby expressly agrees to the relevant house rules and declares that they will behave in accordance with those rules. 2.C. During the Event, these terms and conditions apply to all (further) agreements the Visitor enters into with the Organizer (including the purchase of Tokens and goods purchasable therewith). 2.D. Typographical errors in offers from the Organizer exempt it from any potential obligations for compensation that may arise therefrom, even after the conclusion of the agreement. 2.E. During the Event, these terms and conditions apply to agreements concluded with, through, or by mediation of official (pre-)sale addresses designated by the Organizer. 2.F. If a Visitor orders a Ticket or Tickets for third parties, they declare that they are authorized to accept these terms and conditions and will inform the third party of the applicability of these terms and conditions.
Article 3. Liability
3.A. Visitor is a Consumer: The Organizer’s liability is limited to compensation for direct damage, whereby the amount to be paid to the Visitor will never exceed the amount paid out by the Organizer’s insurer in the relevant case. The Organizer is never liable for indirect damage, including consequential damage, lost profits, missed savings, and damage due to business stagnation. 3.B. Visitor is a Professional (Business): The Organizer is only liable for damage suffered by the Visitor if and insofar as that damage is the direct result of intent or deliberate recklessness by the Festival’s management. Liability in this case is limited to compensation for direct damage up to a maximum of the amount paid out by the Organizer’s insurer in the relevant case. 3.C. The Organizer can never be held responsible for the way artists/acts perform during the Event. 3.D. Changes to the program occurring after the purchase of the Ticket do not entitle the Visitor to cancel the purchase. No refund of the purchase price will take place. 3.E. Entering the Grounds during and/or prior to the Event is entirely at the Visitor’s own risk. Lockers for storing valuables are available on the Grounds unless otherwise indicated. Use of a locker is entirely at the Visitor’s own risk. The Organizer is not liable for damage to, loss of, or theft of the Visitor’s belongings. 3.F. The Visitor declares to be aware that amplified music will be played during the Event. The Visitor is responsible for taking hearing protection measures as needed. The Organizer advises the Visitor to allow the hearing appropriate rest during the event and to wear hearing protection at all times.
Article 4. Force Majeure
4.A. In the event of force majeure, the Organizer has the right to cancel the Event or move it to another date. “Force majeure” includes all unforeseen circumstances that have arisen through no fault or action of the Organizer, such as adverse weather conditions, fire, strikes, cancellation by artist(s), etc. 4.B. If the Event is completely cancelled before it has started due to or in connection with force majeure, the Organizer will refund the purchase price (excluding booking fees) of the Ticket. The Visitor cannot claim any (damage) compensation from the Organizer other than the refund of the purchase price. Refunds will only be processed after the Visitor provides an original, valid, and undamaged Ticket to the Organizer. In other cases, there is no claim to a refund. The Visitor acknowledges that the Brand Owner (Stichting Festival Xperience) is not a party to the purchase agreement of the Ticket. Any claims for refunds of entrance fees can only be directed to the performing Organizer listed as the seller on the Ticket or invoice. The Brand Owner accepts no liability for ticket refunds in the event of cancellation or bankruptcy of the performing Organizer.
Article 5. Cancellation
5.1. The Counterparty must notify the Organizer of total or partial cancellation of the agreement concluded with the Organizer immediately by registered letter. 5.2a. If the Client/Contractor cancels the agreement (partially) more than 30 (thirty) days before the project/event, the Client owes Forever Festival at least 30% of the total invoice amount in addition to any damages. 5.2b. From the 30th day to the 14th day before the event/project, the Client/Contractor owes the Organizer 60% of the invoice amount. 5.2c. For cancellation from the 14th day to 7 (seven) days before the event/project, the Client owes 80% of the invoice amount. 5.2d. If the Client cancels the agreement (partially) within 7 (seven) days before the event/project, the entire invoice amount is due. 5.2e. Articles 8 and 12 of these terms and conditions also apply to payments due under this article, paragraph 2. 5.3. The Client fully indemnifies the Organizer against any claim from the Artist, Supplier, and/or third party arising from the (partial) cancellation of the agreement.
Article 6. Access to the Event
6.A. The minimum age for access to the Event is 18 years, unless otherwise indicated. Only an original, valid, and undamaged Ticket grants access to the Event. 6.B. To gain access to the Event and the Grounds, the Visitor must be in possession of a valid ID (identity card, passport, or driver’s license), which must be shown upon request. Access is possible from the opening time until the closing time. Opening and closing times are stated on the Ticket and on the Event website. The closing time does not necessarily mean the end time of the Event. For safety reasons, it is not possible to temporarily leave the Grounds after entry, unless the Organizer explicitly agrees. 6.C. The Organizer may decide to provide Visitors with a wristband, making it easily visible which part of the Grounds the Visitor has access to or whether they may consume alcohol. The Visitor agrees to cooperate with this. The Visitor must wear the wristband at all times in the designated manner while on the Grounds and during the Event. In case of loss or breaking the seal of the wristband, the Visitor may be removed from the Grounds and denied further access. 6.D. Visitors will be searched (frisked) upon entering the Grounds; items brought by the Visitor may also be searched on the Grounds and during the Event. The Visitor expressly agrees to this and will cooperate. The Organizer determines the reasonable method of control (security personnel, detection gates, etc.). If the Visitor does not cooperate, access to the Grounds and Event will be denied. 6.E. For safety reasons, the Organizer may decide to close parts of the Grounds during certain times or keep them open only for specific Visitors. 6.F. The Visitor shall strictly follow the instructions of the Organizer’s staff and third parties engaged by it, such as police, fire department, health services, first aid, security, (parking) stewards, and traffic controllers. 6.G. Permitted Items: Visitors are only allowed to have the following items for personal use when entering the Grounds, unless stated otherwise in the house rules:

A Visitor found with prohibited items during access control will be denied entry without a refund. If prohibited items are found after entry, the Organizer will remove the Visitor from the Grounds (no refund) and may ban them from future events. Illegal items will be handed over to the police. Legal valuables may be retrieved after the Event.
6.H. Medication: Bringing medication is only permitted if:

It is in the original, sealed packaging with the original patient information leaflet.

A doctor’s note can be provided explaining the use. Failure to comply allows the Organizer to seize the medication without compensation.
Article 7. Violations
7.A. If a Visitor acts in violation of the agreement (including house rules and these terms), they will be removed from the Grounds and denied further access. This ban may also apply to future Events. The Visitor is liable for all (consequential) damage resulting from their actions.
Article 8. Admission Tickets
8.A. The agreement is concluded when the Visitor purchases one or more Tickets. Tickets must be purchased via the Organizer or official sale addresses. A Ticket grants one person one-time access. 8.B. Only the first holder of the Ticket presented at the Event will be granted access. The Organizer is not required to verify if the holder is the rightful owner. 8.C. Risk of loss, theft, damage, or misuse passes to the Visitor once the Ticket is provided. 8.D. Personalization: The Organizer may require Visitors to personalize Tickets (naming) before they are validated or issued. 8.E. The Organizer may refuse to enter into an agreement or dissolve an agreement if there is reasonable ground (e.g., previous bans). 8.F. The Visitor cannot change or dissolve a concluded agreement unless mandatory law dictates otherwise.
Article 9. Prohibition of Resale
9.A. Selling or offering Tickets for commercial purposes (resale at a higher price than the original purchase price or the price set by the Organizer) is prohibited without written permission. Violation allows the Organizer to invalidate the Ticket without a refund and deny access to both buyer and seller.
Article 10. Tokens
10.A. Payment at the Event can only be made with Tokens sold by the Organizer. Tokens remain the property of the Organizer. 10.B. Tokens are only valid for the specific edition of the Event for which they were purchased. Tokens are non-refundable and cannot be exchanged for cash. 10.C. Resale of Tokens is strictly prohibited.
Article 11. Complaints and Limitation Period
11.1. Complaints must be reported directly to the performing Organizer. The Brand Owner (Stichting Festival Xperience) does not handle complaints regarding production, catering, safety, or ticketing. 11.2. The Visitor must allow the Organizer the opportunity to investigate the complaint and, if necessary, rectify the situation. 11.3. All claims against Forever Festival expire if not submitted within 3 months of their origin.
Article 12. Accommodation
12.A. Agreements for Accommodation follow the rules in Article 8. A separate specific Ticket and payment for Accommodation are required. 12.B. Subletting or allowing third parties to use the Accommodation for a fee is strictly prohibited. 12.C. The right to use Accommodation ends (without compensation) when the term expires, if the Visitor is denied access to the grounds, or when the Event ends. 12.D. Cancellation Policy for Accommodation:

3+ months before Event: Full refund (excl. booking/admin fees).

1–3 months before Event: 50% refund (excl. booking/admin fees).

Less than 1 month before Event: No refund. 12.E. The Visitor must act as a “good host,” keeping the Accommodation tidy. Smoking and open fires are strictly prohibited. The Visitor is liable for damage or missing items. 12.F. Visitors must report any defects/loss immediately upon arrival. The Organizer is not liable for theft or loss of items left in the Accommodation.
Article 13. Media and Equipment
13.A. Photo and film recordings are made during the Event. The Visitor explicitly agrees that images and/or sound recordings may be made and distributed via all media forms. 13.B. Reproduction of posters, programs, or digital expressions of the Organizer is prohibited without written consent. 13.C. Non-professional cameras (phones, disposables, compact cameras with fixed lenses) are permitted. Professional equipment (GoPro, telescoping poles, film cameras) is prohibited. 13.D. Violation may result in temporary seizure of equipment or removal from the Grounds without a refund.
Article 14. Event Registration
14.A. By attending, the Visitor agrees to the exploitation, publication, and reproduction of recordings made of them during the Event in the broadest sense. No compensation is due. 14.B. The Visitor transfers any (portrait/neighboring) rights to the Organizer and waives personality rights.
Article 15. Personal Data and Privacy
15.A. The Organizer processes personal data in accordance with the Dutch Data Protection Act and the GDPR (AVG). See the privacy policy on our website.
Article 16. Other Provisions
16.A. Violation of these rules may lead to immediate removal and future bans without a refund. The Visitor must reimburse the Organizer for any fines imposed on the Organizer due to the Visitor’s actions. 16.B. Under 18s are strictly prohibited from purchasing, carrying, or consuming alcohol. Providing alcohol to a minor is strictly prohibited. 16.C. Visitors must use the provided toilet facilities. Public urination/defecation is strictly prohibited. 16.D. Throwing drinks or objects is strictly prohibited. 16.E. Smoking is prohibited in all indoor and covered locations. 16.F. Vandalism and theft of property (Organizer or third party) are criminal offenses and will be reported to the police. 16.G. Unauthorized sales or advertising on or around the Grounds are prohibited. Violators risk a fine of at least €750 per violation.
Article 17. Final Provisions
17.A. Dutch law applies exclusively. These terms are drafted in Dutch and translated into English. In case of inconsistency, the Dutch version is binding. The Court in Maastricht has exclusive jurisdiction. 17.B. For consumers, if the designated court does not have relative jurisdiction by law, the Visitor has one month to opt for the legally competent court.
Forever Festival is a registered trademark of Stichting Festival Xperience. The organization and execution of events are carried out by independent licensees.
